This Act establishes the Building and Construction Authority (Authority) as an autonomous body with legal personality responsible for regulating, improving and ensuring sustainable management of Malta's building and construction industry. The Authority succeeds functions previously held by the Building Regulation Board, the Building Regulation Office, the Building and Construction Agency, and the Board for Construction Builders under the Police Laws Code, consolidating construction industry oversight into a single entity. The Authority's key functions include issuing certifications, orders, licences, permits and exemptions; establishing guidelines and best practices; processing complaints and reports of alleged breaches; promoting research, education and public awareness; maintaining registers of service providers; and coordinating with other competent authorities. The Act applies to all construction works — permanent and temporary — including excavation, demolition, construction, building services and finishing works. All persons and entities executing building works must comply with best industry practices, respect environmental standards, and adhere to principles of sustainability, structural integrity, quality and energy efficiency from inception through construction and use. The Authority is governed by a Board and headed by a Chief Executive Officer with distinct legal representation authority. The Authority is subject to public financial management legislation and may impose fees, rates and charges as prescribed. The Act became operative on 30 April 2021 with further amendments effective 29 October 2021. Enforcement mechanisms, a national building code, licensing requirements, exemptions, a dedicated tribunal, and a consultative council are established to support regulatory oversight.
