This Act, enacted by the Parliament of Malta and commencing 1 January 2027, establishes the 'right to be forgotten' for cancer survivors in Malta. It prohibits third parties (employers, financial institutions, service providers) from requesting, considering, or using a recovered cancer patient's medical history to discriminate, impose stricter terms, or deny access to employment contracts, service contracts, or financial services agreements once a prescribed period has elapsed. The prescribed period is generally 10 years from the date of completion of active treatment, reduced to 5 years for those diagnosed before age 25. The Act defines key terms including 'oncological disease' (cancer), 'person who recovered' (those in remission post-treatment), 'relapse' (return of cancer, excluding unrelated health conditions), and 'established period' (time from end of treatment without relapse). The Act establishes a Board of Review comprising a President (attorney with 7+ years practice) and two medical professionals specializing in oncology, appointed by the Minister of Health, to determine disputed diagnosis and treatment completion dates and to recommend adjustments to prescribed periods based on medical progress. Third parties must anonymize retained medical records after the prescribed period expires and notify the recovered person in writing. Clauses in existing or new contracts conflicting with the Act become void and unenforceable, though such voidness does not invalidate the entire contract. The Minister may prescribe shorter periods through Schedule for specific oncological diseases. Violations by parties other than the recovered person constitute an offence punishable by a fine of at least €500 and up to €5,000 (text incomplete).
