A male employee secretly filmed two female colleagues in the bathroom at their shared workplace in Gozo between April and July 2025, and shared the footage without their consent. He was charged under three separate criminal provisions covering non-consensual sharing of intimate images, sexual harassment, and stalking. After initially pleading not guilty, he entered an unconditional guilty plea after investigative footage was shown in court. The court sentenced him to one year imprisonment suspended for four years, a three-year Treatment Order under probation supervision, a two-year Restraining Order protecting both victims, and €1,500 compensation to each victim.
The defendant pleaded guilty on all three counts after an unconditional admission in court. The prosecution and defence agreed that a custodial sentence was not appropriate in the circumstances. The court agreed with this assessment but noted the sentence for community service would have been too lenient for such serious offences. In mitigation: early guilty plea, full cooperation with police, no prior convictions, had already sought professional help, limited employment scope (medical field). Against: the gravity of the violation of workplace privacy and the lasting psychological impact on both victims. The court specifically noted that all workers have the right to peace of mind at work free from such experiences. The court also recommended to relevant authorities that the sentence should not prevent the offender from resuming employment, provided he is never placed in a position where he has unsupervised access to vulnerable individuals.
