Court of Magistrates (Malta) — Criminal · Magistrate Dr. Monica Vella LL.D., M.Jur. · 23 July 2025
On 22 August 2021 in Birkirkara, Cranston Portelli used a pointed instrument (knife) to inflict grievous bodily harm on James Manfre, causing injuries that resulted in a permanent defect — disfigurement or impairment — to one of his hands. This triggered the 'grievous' classification under Art. 216 of the Criminal Code. Portelli was also charged with carrying a knife without a police licence and threatening behaviour. The court convicted him and, taking into account all circumstances including the victim's conduct which had contributed to the situation, sentenced him to 2 years imprisonment suspended for 2 years plus a 2-year restraining order protecting the victim. Note: This case was subsequently appealed — see the related appeal decision case-520-2021 in which the Court of Criminal Appeal largely upheld the conviction but removed one expert fee item.
Guilty of grievous bodily harm (Art. 216), carrying a pointed weapon without licence (Ch. 480), and threats (Art. 339(1)(e)). Sentenced to 2 years imprisonment suspended for 2 years. 2-year restraining order in favour of James Manfre. Expert costs of approximately €6,700 ordered.
