A developer built a parapet wall at a lower height than originally agreed during works on adjacent land at Ta' Ghar Lapsi, Siggiewi. The landowner went to court and won an order to have it restored.
Civil Court (First Hall) · Judge Henri Mizzi · 26 March 2026
Lapsi Estates Limited owns land known as 'Ta' Ghar Lapsi' in the limits of Siggiewi, acquired originally in 1966. Adjacent to this land, David Bondin (later operating under the name LAPSEA Luxury & Adventure Group Limited) undertook construction works. During those works, a parapet wall — which formed part of the boundary between the two properties — was reduced in height from what it originally stood at, contrary to what had been agreed. Lapsi Estates sued to have the wall restored to its original height. The court found in favour of Lapsi Estates and ordered LAPSEA to restore the parapet wall to its original height as it stood before the works began, under the supervision of Architect Michael Lanfranco. Costs were split 80% against LAPSEA and 20% against Lapsi Estates, reflecting that both parties bore some responsibility for the dispute.
Lapsi Estates won. LAPSEA ordered to restore the parapet wall to original height at its own expense, under architect supervision. Costs split 80% LAPSEA, 20% Lapsi Estates.
